Terms of Service

DevSMS service is provided by MYSTAR LLC and operates through the Eskiz.uz SMS gateway.

These "Terms of Service" (hereinafter — "Terms") define the procedure for using the DevSMS platform, the rights and obligations of the user, and the limits of liability of the service provider. By registering on the platform, logging in, or using any service, you unconditionally and irrevocably confirm your agreement with all provisions of these Terms. If you do not agree with any provision, immediately cease using the service.

1. Terms and Definitions

1.1. "Service" or "Platform" — the DevSMS platform, all its functions, web interface, API endpoints, and other components.

1.2. "User" — any individual or legal entity registered on and/or using the service.

1.3. "SMS Gateway" — SMS delivery infrastructure provided by Eskiz.uz.

1.4. "Template" — an SMS text template subject to approval by Eskiz.uz.

1.5. "Universal OTP Template" — pre-approved standard templates by Eskiz.uz allowing users to insert their company/service name and OTP code.

1.6. "API" — application programming interface for accessing the service.

1.7. "Moderation" — the process of reviewing SMS content or service parameters by the AI system and/or administration.

1.8. "Prohibited Content" — any content that is offensive, threatening, fraudulent, illegal, impersonating other persons or organizations, or otherwise in violation of these Terms or the laws of the Republic of Uzbekistan.

1.9. "Confiscation" — the irrevocable seizure of all funds from the user's balance by the service.

1.10. "Administration" — the management and authorized employees of MYSTAR LLC operating the DevSMS service.

2. General Provisions

2.1. Using the service means you have read, understood, and fully agree with these Terms.

2.2. The Administration reserves the right to modify, supplement, or revise these Terms at any time without prior notice. Changes take effect immediately upon publication on the website.

2.3. Notification of changes: The Administration may, but is not obligated to, notify users of changes through one or more of the following channels:

  • • DevSMS website (devsms.uz/terms.php) — the official and primary source
  • • Official Telegram channel (@devsms_uz) — at the Administration's discretion
  • • In-system notifications — at the Administration's discretion

2.4. Claiming lack of notification is not accepted as a defense. The User is independently obligated to regularly review these Terms and stay informed of updates. Continued use of the service after Terms are updated constitutes unconditional acceptance of the new terms.

2.5. These Terms constitute the sole and complete agreement between the User and DevSMS. All prior oral or written agreements are superseded.

3. Registration and Identification

3.1. Registration via phone number is required to use the service.

3.2. IMPORTANT: The service does not require identity documents (passport, ID card) from users. However, the Administration reserves the right to request additional identification when necessary.

3.3. The User bears full responsibility for the accuracy and correctness of all entered data.

3.4. The User is obligated to keep account access credentials (password, token, API key) confidential and not share them with third parties.

3.5. All actions performed through the User's account, including those performed by third parties, are deemed to have been performed by the User, and the User bears full responsibility.

3.6. If unauthorized access to your account is detected, immediately notify the Administration. The User remains liable for all actions until notification is received.

4. Service Usage and Restrictions

4.1. The service is intended exclusively for lawful purposes in accordance with the laws of the Republic of Uzbekistan.

4.2. Permitted use: verification codes (OTP), system notifications, technical alerts, service messages, and other lawful purposes.

4.3. STRICTLY PROHIBITED:

  • • Sending unsolicited bulk messages (spam) without recipients' consent
  • • Using the service for fraud, deception, or dissemination of false information
  • • Sending offensive, threatening, defamatory, or illegal messages
  • • Sending advertising messages without an approved template
  • • Unauthorized sending of messages on behalf of other persons, organizations, government agencies, or brands
  • • Attempting to circumvent, breach, or abuse the platform's security systems (AI moderation, rate limiting, etc.)
  • • Impersonation or unauthorized use of names of financial institutions, banks, payment systems, or government agencies
  • • Any messages intended to mislead, intimidate, or deceive the SMS recipient

4.4. Users who violate any of the above rules will be immediately blocked without prior notice, all funds on their balance will be confiscated, and they may be held liable in accordance with the laws of the Republic of Uzbekistan.

5. Full Responsibility for SMS Content

5.1. The User bears FULL, SOLE, AND UNLIMITED responsibility for the content of ALL SMS messages sent through the DevSMS platform.

5.2. This responsibility is unconditionally maintained in all of the following cases:

  • • The message was sent intentionally
  • • The message was sent unknowingly, by mistake, or due to negligence
  • • The message was sent with incorrect content due to a technical error or human factor
  • • The message was sent by a third party through the User's account
  • • The message was sent via API, web interface, or any other method

5.3. DevSMS acts exclusively as a technical intermediary (platform). The platform provides technical infrastructure for SMS transmission and does not create, edit, or assume any obligation to approve message content.

5.4. Every SMS sent by the User, including service names used in Universal OTP templates, OTP codes, and other parameters, is under the User's personal responsibility.

5.5. Any complaints, claims, objections, or demands from SMS recipients are directed exclusively to the sender (User). DevSMS assumes no liability for such claims.

5.6. By accepting these Terms, the User assumes all legal, financial, moral, and other consequences arising from SMS messages they have sent.

5.7. Under no circumstances shall DevSMS, its management, employees, or partners be liable for the content of SMS messages sent by the User. This rule applies regardless of whether the message is lawful or unlawful.

6. AI Moderation System and Penalties

6.1. The DevSMS platform uses an artificial intelligence (AI)-based moderation system for automatic SMS content review.

6.2. The AI moderation system is employed to protect users and ensure the platform's lawful operation; however, it does not impose any liability on DevSMS for SMS content.

6.3. PENALTY MECHANISM: If the AI moderation system determines that message content or service parameters (company name, etc.) are prohibited:

  • • The SMS WILL NOT BE SENT to the recipient
  • • The full message cost WILL BE DEDUCTED from the User's balance (as a penalty)
  • • The deducted funds WILL NOT BE REFUNDED
  • • The incident will be recorded in the security log

6.4. The User confirms full awareness of the AI moderation system's existence and unconditionally agrees to the penalty mechanism. Penalties may be applied without prior notification.

6.5. AI moderation decisions are final and review is not guaranteed. The Administration may review decisions at its discretion but is not obligated to do so.

6.6. Attempting to bypass the moderation system — including sending Universal Template texts with prohibited content through the regular SMS form — constitutes a particularly serious violation and results in additional sanctions.

6.7. Detection of prohibited content (one or more times) gives the Administration the right to IMMEDIATELY AND COMPLETELY block the User and CONFISCATE ALL funds on their balance.

6.8. Confiscated funds WILL NOT BE RETURNED UNDER ANY CIRCUMSTANCES OR FOR ANY REASON WHATSOEVER.

6.9. The moderation system is not perfect and may not detect all prohibited content. The AI moderation system's failure to flag a message does not release the User from liability. The responsibility established in Section 5 remains in full effect for every message sent.

7. Universal OTP Template Terms

7.1. Universal OTP templates are pre-approved standard templates by Eskiz.uz that allow users to insert their company/service name and OTP verification code.

7.2. The User bears FULL RESPONSIBILITY for ANY name entered in the "company/service name" field of a Universal Template.

7.3. The following are STRICTLY PROHIBITED as company names in Universal Templates:

  • • Offensive, defamatory, or immoral words
  • • Names of other companies, brands, or trademarks (e.g., Uzcard, Payme, Click, Humo)
  • • Names of government agencies, banks, or financial institutions (e.g., Central Bank, Tax Committee, Ministry of Foreign Affairs)
  • • Any names intended for deception, fraud, or misleading
  • • Any names that violate the laws of the Republic of Uzbekistan

7.4. When a prohibited company name is detected, all provisions of Section 6 (AI Moderation System and Penalties) apply in full.

7.5. The OTP code field must contain only digits (4 to 8 digits). No other characters are accepted.

8. Eskiz.uz SMS Gateway Integration

8.1. DevSMS uses the Eskiz.uz platform for SMS delivery.

8.2. All SMS messages are sent through the Eskiz.uz infrastructure and are subject to their terms.

8.3. Template Approval: All SMS templates (except Universal Templates) are reviewed and approved by Eskiz.uz.

8.4. The template approval process may take up to 1-3 business days.

8.5. Eskiz.uz reserves the right to reject a template. Rejected templates may be revised and resubmitted.

8.6. The User is obligated to comply with all rules and restrictions established by Eskiz.uz.

9. Payments and Financial Terms

9.1. Payment for each SMS is deducted from the balance according to the established tariff. The tariff is calculated based on the number of SMS parts.

9.2. Payment is also charged for SMS successfully transmitted to Eskiz.uz but not delivered to the recipient (FAILED, REJECTED, EXPIRED). These are the terms of Eskiz.uz and mobile operators; DevSMS is not responsible for non-delivery and funds are not refunded.

9.3. For SMS blocked by the AI moderation system, the full payment is deducted as a penalty and is not refundable (see Section 6).

9.4. Funds deposited to the balance are intended exclusively for service usage and are treated as prepayment.

9.5. REFUND POLICY: Deposited funds are generally NON-REFUNDABLE. Exceptions:

  • • Only funds erroneously deducted due to a technical fault of the DevSMS platform
  • • Only in cases confirmed by the Administration

9.6. Tariffs may change without prior notice. New tariffs apply only to SMS sent after the change.

10. Privacy and Data Protection

10.1. We are committed to protecting users' personal data.

10.2. Data collected: phone number, sent SMS history, balance data, IP addresses, usage statistics.

10.3. Data is not shared with third parties, except in the following cases:

  • • By court order
  • • By official request of law enforcement agencies
  • • When necessary for technical integration with Eskiz.uz
  • • For the purpose of detecting and preventing fraud or illegal activity

10.4. We use modern encryption and protection methods for secure data storage.

10.5. For moderation purposes, the content of sent SMS messages, service names, and other parameters may be analyzed by the AI system. The User consents to this.

11. Limitation of Liability and Disclaimer of Warranties

11.1. The service is provided "AS IS" and "AS AVAILABLE," without any express or implied warranties.

11.2. DevSMS ASSUMES NO LIABILITY WHATSOEVER for:

  • • The content of SMS messages sent by the User and their consequences
  • • Damages caused to third parties as a result of SMS sent by the User
  • • Complaints, claims, or demands from SMS recipients
  • • Technical failures or service interruptions on the Eskiz.uz platform
  • • Internet connection interruptions or slowdowns
  • • Non-delivery of SMS by mobile operators
  • • Incorrectly entered data by the User (phone number, message text, etc.)
  • • Failure of AI moderation to detect prohibited content or blocking of legitimate content
  • • Force majeure events (natural disasters, war, government decisions, power outages, etc.)

11.3. The aggregate liability of DevSMS (if any) shall in no event exceed the amount paid by the User for services during the preceding 30 days.

11.4. DevSMS shall not be liable for indirect, incidental, special, or consequential damages, including: lost profits, data loss, reputational harm, or lost business opportunities.

12. Indemnification Obligation

12.1. By accepting these Terms, the User assumes the following obligation:

12.2. The User agrees to indemnify, defend, and hold harmless DevSMS, its management, founders, employees, agents, and partners (including Eskiz.uz) from:

  • • Any claims, complaints, or demands arising from SMS messages sent by the User
  • • Any damages arising from the User's violation of these Terms
  • • Fines, sanctions, or legal costs arising from the User's violation of the laws of the Republic of Uzbekistan
  • • Claims arising from the User's violation of third-party rights

The User shall FULLY DEFEND AND COMPENSATE AT THEIR OWN EXPENSE all damages incurred, including court costs, attorney fees, fines, and compensation payments.

12.3. This obligation survives the termination of these Terms, the blocking or deletion of the User's account.

13. Account Blocking, Suspension, and Fund Confiscation

13.1. The Administration reserves the right to IMMEDIATELY AND COMPLETELY block the User's account WITHOUT PRIOR NOTICE in the following cases:

  • • Violation of any provision of these Terms
  • • Detection of spam, fraud, or illegal activity
  • • Detection of prohibited content by the AI moderation system (one or more times)
  • • Attempting to bypass the moderation system
  • • Causing harm to other users or third parties
  • • Any activity threatening the security of the platform
  • • At the request of law enforcement agencies

13.2. FUND CONFISCATION: ALL remaining funds on a blocked account are confiscated (seized by the service).

13.3. Confiscated funds WILL NOT BE RETURNED UNDER ANY CIRCUMSTANCES, FOR ANY REASON, OR UPON ANY REQUEST WHATSOEVER. This rule is unconditional and final.

13.4. The Administration is not obligated to explain the reason for blocking.

13.5. The User may file a written objection (via support@devsms.uz). The Administration may review the objection at its discretion but is not obligated to do so. Regardless of the review outcome, confiscated funds are not returned.

13.6. The User may request deletion of their account at any time.

13.7. Upon account deletion, all data is permanently deleted and cannot be restored. Remaining funds are not refunded.

14. Intellectual Property

14.1. The DevSMS platform, its design, logo, source code, and all content are intellectual property.

14.2. The User may use the platform solely for purposes specified in these Terms.

14.3. Copying, redistribution, decompilation, or commercial use of the platform is prohibited.

15. Dispute Resolution

15.1. All disputes shall first be attempted to be resolved through negotiation.

15.2. If no agreement is reached, disputes shall be resolved by the competent court in accordance with the laws of the Republic of Uzbekistan.

15.3. A preliminary written request is mandatory (support@devsms.uz). The Administration responds within 10 business days.

15.4. The interpretation and application of these Terms shall be governed by the laws of the Republic of Uzbekistan.

16. Final Provisions

16.1. These Terms are drawn up and governed in accordance with the laws of the Republic of Uzbekistan.

16.2. If any provision of these Terms is found invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.

16.3. Failure or delay by the Administration in enforcing any provision of these Terms shall not be construed as a waiver of that or any other provision.

16.4. The User may not assign their rights and obligations under these Terms to third parties without the written consent of the Administration.
